This document, together with the terms and use of the website, sets out the conditions for booking trips and the other services offered (hereinafter, the "Terms").

Please read the Terms carefully before making any transaction. By using this website or placing an order through it, you agree to be bound by these Terms, so if you do not agree with all of the Terms, you must not use this website.

These Terms may be modified. It is your responsibility to read them periodically, since the terms in force at the time you use the website or place an order will be the ones that apply to you.

HOW TO REGISTER

You must register in order to access our services; the user must register by filling in the registration form, where they will be asked for personal information that must be kept up to date and accurate. At the end of the registration process, the user must accept these GENERAL BOOKING TERMS and our PRIVACY POLICY.

The registration user ID and password, where required, must be kept in a secure place. Once you have obtained your user ID and password, you will be able to access the "My Account" section (LOG IN) where you can modify your registration details and view and monitor the status of your bookings.

USE OF OUR WEBSITE

By using this website and/or placing orders through it, you agree to:

Use the services only to make legally valid enquiries or bookings.
Not carry out any false or fraudulent transaction. If it could reasonably be considered that such a transaction has been carried out, we will be authorised to cancel it and inform the relevant authorities.

By making an enquiry or request for services through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts.

TERRITORIAL SCOPE

The services offered through our website are only available to persons legally resident in Spanish territory.

BOOKINGS THROUGH OUR WEBSITE

To make any booking for trips or the other services offered by Viajes Jaipur, you must select a valid payment method, authorising us to make charges using that selected payment method.

Any transaction is subject to the User reading and accepting these General Booking Terms. Once these have been accepted, as well as the booking terms applicable to the booking and purchase of the selected product, and once the corresponding payment has been made, we will complete the transaction as soon as possible.

If, due to certain circumstances, we are unable to complete the orders placed, we will notify you as soon as possible.

PRICES AND PAYMENT METHODS

All prices offered on our website are shown in EUROS (EUR). The purchase and sale of virtual currencies is not subject to VAT; however, any tax obligations that the transactions ordered may generate are your sole responsibility.

Payments and refunds for all transactions will be made in euros (EUR). If your credit/debit card is not denominated in EUROS, the exchange rate will be applied by the corresponding bank according to the market exchange rate and may vary from the price shown on our website.

In the case of package trips, the price of the package trip has been calculated based on currency exchange rates, transport fares, the cost of fuel or other energy sources, fees, taxes and other tourist surcharges, including landing, embarkation and disembarkation fees at ports and airports, where these are expressly included as applicable on the date the pre-contractual information was provided.

Unless stated otherwise, the advertised programme reflects prices per person with accommodation in a standard double room and economy class flights.

Any variation in the price of the aforementioned elements may give rise to a revision of the final price of the trip, either upwards or downwards, by the exact amounts of the price variations referred to. These modifications will be notified in writing to the traveller. Price revision, in accordance with the provisions of Article 158 of Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for the Defence of Consumers and Users and other complementary laws, will only take place if the trip organiser has expressly reserved that right and has communicated it to you in the pre-contractual information provided before booking.

Under no circumstances will the price of the trip be revised upwards in the 20 days immediately preceding the departure date. If the price increase exceeds eight percent of the price of the package trip, the traveller may terminate the contract by notifying the organiser.

The payment methods available on our website will be shown during the booking completion process.

Viajes Jaipur will always use secure payment methods. Viajes Jaipur will not keep in its files any information regarding the details of the cards used. By using a debit/credit card, the user confirms that the card used belongs to them or that they have been duly authorised by the card's owner to use it. Credit/debit card transactions will be subject to a security and validation check by the card issuer. If the card issuer declines the transaction, Viajes Jaipur will not be responsible for any delays or cancellations of the transactions. When funds are provided by credit or debit card, any charges or commissions charged to Viajes Jaipur by the payment service provider will be borne solely by the customer.

ORDER CONFIRMATION

Orders are subject to acceptance by Viajes Jaipur, to the user complying with and accepting the GENERAL BOOKING TERMS, and to market availability. Viajes Jaipur reserves the right not to accept an order if the payment information is not approved, or if any other type of issue relating to the portal's General Terms of Use is detected. When you make a transaction through our website, we may send you a confirmation email with details of the transaction. Check that the details in the confirmation message are correct as soon as possible and keep a copy for your records.

RIGHT OF WITHDRAWAL

The transactions carried out on our website include: trips, activities and tourist services contracted directly with different providers and tour operators. All of them are subject to the right of withdrawal under the terms and refund conditions that the service provider establishes for each product in the package travel contract or in the purchase of standalone services in each case, and of which you will be made aware before accepting payment.

OUR RIGHT TO MODIFY THESE TERMS

Viajes Jaipur may review and modify these Terms at any time.

You will be subject to the policies and Terms in force at the time you use this website or carry out each transaction, unless, by law or decision of government bodies, we must make retroactive changes to such policies, Terms or PRIVACY POLICY, in which case any such changes will also affect orders you have previously placed.

PROTECTION OF PERSONAL DATA

In accordance with the provisions of the General Data Protection Regulation and other applicable regulations on the matter, we inform you that the personal data you provide us through our website or by sending emails will be processed by Viajes Jaipur as data controller in order to carry out the requested transactions, as well as to receive periodic notifications through electronic means. DISCLAIMER OF LIABILITY

We will not be liable for any failure or delay in fulfilling any of the obligations assumed, when this is due to events beyond our reasonable control ("Force Majeure Event"). Force Majeure Events shall include any act, event, failure to exercise, omission or accident beyond our reasonable control, including, among others, the following:

(i) Strikes, lockouts or other industrial action.

(ii) Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not), threat or preparation for war.

(iii) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.

(iv) Impossibility of using trains, ships, aircraft, motor transport or other means of transport, public or private.

(v) Impossibility of using public or private telecommunications systems.

(vi) Acts, decrees, legislation, regulations or restrictions of any government or public authority.

Our obligations will be deemed suspended for the period during which the Force Majeure Event continues, and we will have an extension of the time in which to fulfil such obligations for a period of time equal to the duration of the Force Majeure Event. We will use all reasonable means to bring the Force Majeure Event to an end or to find a solution that allows us to fulfil our obligations despite the Force Majeure Event.

ENTIRE AGREEMENT

These Terms and any document expressly referred to in them constitute the entire agreement between you and us in relation to their subject matter and replace any other prior pact, agreement or promise made between you and us, verbally or in writing.

You and we acknowledge that we have agreed to enter into a contract without relying on any statement or promise made by the other party or that might be inferred from any statement or document in the negotiations entered into by the two of us prior to it, except as expressly stated in these Terms.

Neither you nor we will have any recourse against any untrue statement made by the other party, verbally or in writing, prior to the date of a contract (unless such untrue statement was made fraudulently), and the only recourse available to the other party will be for breach of contract in accordance with the provisions of these Terms.

If any of these Terms, or any provision of a contract, are declared null and void by a final decision issued by a competent authority, the remaining terms and conditions will remain in force, unaffected by such declaration of nullity.

JURISDICTION AND APPLICABLE LAW

The sale is deemed to take place on Spanish territory, so Spanish law will apply to any interpretative or contentious questions that may arise, and, in the event of a dispute, both parties agree to submit, waiving any other jurisdiction that may apply to them, to the jurisdiction of the Courts and Tribunals of the Consumer's domicile.
